Terms & Conditions

These Terms & Conditions (“Terms”) govern your use of the products, services, and platform of Artfare Company LLC (“Artfare,” “we,” “our,” or “us”). By using Artfare, you acknowledge that you have read, understood, and agreed to be bound by these Terms.

1. Welcome to Artfare

Artfare designs, manufacturers, and sells practical point-of-sale products for sellers, performers, and nonprofits. By using Artfare's products, services, and platform ("platform"), you agree to these Terms. If you do not accept these Terms, do not use the Artfare platform.

2. Changes to These Terms

We may occasionally update these Terms to reflect changes in our platform or for legal/commercial reasons. Material changes will be communicated in advance where practical. Continued use of the platform after any changes constitutes your acceptance.

3. Your Account

To use Artfare, you must be 18+ and provide accurate information. You are responsible for maintaining the confidentiality of your account and for all activity under your account. Use of automated bots or impersonation of others is prohibited.

4. Your Username

MerchantIDs must be appropriate and not infringe upon trademarks or other rights. We reserve the right to reassign usernames or remove accounts that violate this policy.

5. Your Content

You are responsible for any content you post (e.g., business name, images, descriptions). Content must be accurate, lawful, and not infringe on others' rights. Harmful or misleading content may result in suspension.

6. What We Can Do with Your Content

By posting content, you grant Artfare a non-exclusive, royalty-free license to use and display it on our platform and in related marketing. You retain ownership, but understand content may be publicly visible and shared.

7. Your Responsibility to Your Customers

You are solely responsible for customer interactions, including payment fulfillment, refund policies, and compliance with applicable laws. If you collect donations, they must be voluntary and not in exchange for goods or services.

8. Fees and Payment

Artfare reserves the right to adjust fees with advance notice. All applicable taxes and third-party processing fees (e.g., Venmo, Cash App, PayPal, Zelle) are your responsibility.

9. Suspension or Termination

We may suspend or terminate your account for violations of these Terms, inactivity, or other reasons at our discretion. If your account is terminated, content may be deleted and no refunds will be issued unless required by law.

10. Feedback

We welcome suggestions to improve Artfare. Feedback may be used without compensation. Any beta features are provided “as is.”

11. Our Platform

You may use Artfare's services solely for lawful purposes related to your merchant activity. Unauthorized use, scraping, reverse engineering, or impersonation is prohibited. Artfare's logos, designs, and software remain our property.

12. Privacy

Your use of Artfare is subject to our privacy practices. You are responsible for protecting visitor data and complying with privacy laws. See the Privacy Policy below for more details.

13. Liability

We are not liable for indirect or consequential damages, including loss of income or data. Our liability is limited to the amount paid by you in the past 12 months or $100, whichever is greater.

14. Disclaimers

Artfare is provided “as is” without warranties. We do not guarantee uptime or that content is accurate, complete, or virus-free.

15. Third-Party Services

Artfare may integrate with third-party tools (e.g., webservers, Venmo, Cash App, PayPal). You are responsible for reviewing and complying with their terms. Artfare disclaims liability for third-party services.

16. Governing Law

These Terms are governed by the laws of California, USA. Disputes shall be resolved in the courts of Santa Clara County, CA.
