Terms & Conditions

These Terms & Conditions (“Terms”) govern your use of the products, services, and platform of Artfare Company LLC (“Artfare,” “we,” “our,” or “us”). By creating an account, accessing the Artfare dashboard, or clicking “I Agree,” you acknowledge that you have read, understood, and agreed to be bound by these Terms and Policies.

1. Welcome to Artfare

Artfare designs, manufactures, and sells practical point-of-sale products for sellers, performers, nonprofits, and small businesses. By using Artfare's products, services, and platform (“Platform”), you agree to these Terms. If you do not accept these Terms, do not use the Artfare Platform.

2. Changes to These Terms

We may occasionally update these Terms to reflect changes in our Platform or for legal or commercial reasons. Material changes will be communicated in advance where practical. Continued use of the Platform after any changes constitutes your acceptance of the updated Terms.

3. Your Account

To use Artfare, you must be 18 years of age or older and provide accurate information. You are responsible for maintaining the confidentiality of your account and for all activity under your account. Use of automated bots, impersonation of others, or unauthorized access is prohibited.

4. Your Content

You are responsible for any content you post or configure on Artfare, including business names, images, descriptions, payment links, external links, contact methods, and branding elements. Content must be accurate, lawful, and must not infringe upon the rights of others.

You are solely responsible for ensuring that your use of Artfare signs, branding, links, payment methods, and content complies with applicable laws and does not infringe upon trademarks, copyrights, publicity rights, or other rights of third parties.

You are responsible for reviewing, testing, and verifying that all payment methods, external links, contact information, QR codes, and external services configured through Artfare are accurate and functioning properly. Artfare is not responsible for errors caused by incorrect, outdated, incomplete, or misconfigured merchant information or third-party accounts.

Harmful, deceptive, misleading, or infringing content may result in suspension or termination.

5. What We Can Do with Your Content

By posting content, you grant Artfare a non-exclusive, royalty-free license to use, reproduce, display, and distribute that content on our Platform and in related marketing materials. You retain ownership of your content, but understand that portions of it may be publicly visible or shared.

6. Your Responsibility to Your Customers

You are solely responsible for customer interactions, including payment fulfillment, payment disputes, refund policies, donations, customer support, and compliance with applicable laws.

7. Fees and Payment

Artfare reserves the right to adjust fees with advance notice where practical. All applicable taxes and third-party processing fees are your responsibility.

8. Suspension or Termination

We may suspend or terminate your account for violations of these Terms, suspected fraud or abuse, inactivity, legal or security concerns, or other operational reasons at our discretion.

9. Feedback

We welcome suggestions to improve Artfare. Feedback may be used without compensation or attribution.

10. Our Platform

Artfare may support payment links, social media links, business websites, contact methods, donation tools, review links, WiFi access information, and other merchant-configurable external services.

Artfare does not process, hold, transmit, or receive customer funds. Artfare provides signage, QR code, and routing tools that direct users to third-party payment providers and external services selected by merchants.

You may not use Artfare for fraudulent, deceptive, unlawful, or unauthorized fundraising, payment activity, impersonation, or illegal activity.

Artfare reserves the right to remove, disable, restrict, or suspend content, links, QR codes, or accounts that create legal, security, operational, fraud, abuse, or reputational risk.

11. Privacy

Your use of Artfare is subject to our Privacy Policy and related privacy practices.

12. Liability

To the fullest extent permitted by law, Artfare shall not be liable for indirect, incidental, special, consequential, or punitive damages, including loss of profits, revenue, goodwill, or data.

Our total liability arising from or related to your use of Artfare shall not exceed the amount paid by you to Artfare in the previous 12 months or $100 USD, whichever is greater.

13. Disclaimers

Artfare is provided “as is” and “as available” without warranties of any kind.

Artfare may modify, suspend, or discontinue features or services at any time without notice.

14. Third-Party Services

Artfare may integrate with or link to third-party services including payment providers, social platforms, business tools, messaging services, websites, review platforms, and other external services. Artfare disclaims liability for third-party services, content, outages, policies, actions, or availability.

15. Governing Law

These Terms are governed by the laws of the State of California, USA.
